This email is to inform you I received today October 19, 2022, Akelius Canada Ltd. N1 notice of rent increase for January 1, 2023. Notice was back-dated on September 28, 2022.
The point here is the notices were delivered by hand and deposited into the tenant’s mailboxes on October 19, 2022. Instead of the minimum 90-day notice by Ontario law, this results in a 73-day notice making it a violation of the Residential Tenancies Act, 2006, S.O. 2006, c. 17.. It is the responsibility of Akelius Canada Ltd. to issue a new N1 notice to tenants.

The office printers were out of order for a while because of a part not being available on time. I believe that has been fixed and all the pending prints have been sent out.
As for the AGI, my manager is looking into this and is in touch with the legal team.
NEW N1 NOTICES ISSUED FOR MARCH 1, 2023
After a number of calls from tenants the N1 notices received on October 19, 2022, have now been resolved for
most tenants at 111 Lawton Blvd. with the issuance of new N1 notices with the
proper 90-day notice. The rent increase for 2023 will now take place on March
1, 2023, instead of January 1, 2023.
THERE IS A FURTHER PROBLEM FOR 19 TENANTS WITH THE NEW N1 FORM FOR
RENT INCREASE ON MARCH 1, 2023
A problem remains with 19 tenants who are entitled to a reduction in rent under Ontario law starting October 1, 2022, of 0.82% from an AGI issued in 2006. The new N1 rent increase for March 1, 2023, for these tenants does not reflect the reduction making these notices fall into the category of collecting illegal rent (0.82% reduction).and possibly void because of the inaccurate amounts listed.
I would encourage the 19 tenants to forward an email to Akelius Canada Ltd. and their property representatives demanding the reduction of 0.82% in their rent starting October 1, 2022, as you will need backup correspondence if this should result in a future case against Akelius Canada Ltd. being brought before the Landlord and Tenant board.
