2006 ABOVE GUIDELINE RENT REDUCTION

 URGENT:  ABOVE GUIDELINE RENT REDUCTION 2006

Since August 31, 2022, I have been corresponding with Akelius Canada Ltd. and two of their employees Mr. Gregory Simon, Property Manager, and Ms. Neusha Shahriar-Husain, Property Administrator for 111 Lawton Blvd. All three parties are aware the AGI 2006 order expired September 30, 2022, ordering a rent reduction of 0.82% for the tenants listed in the order TSL-84316 starting October 1, 2022. Only current tenants residing in the same apartment unit at the time of the order are entitled to the reduction. Review your copy of order TSL-84316 for further information.

Akelius Canada Ltd. has been avoiding implementing the ordered rent reduction in TSL-84316. If you have not received the 0.82% rent reduction as ordered by the Landlord and Tenant Board, I would suggest on your next rental payment for June 1, 2023, you reduce your rent per TSL-84316. I have included a sample of a letter you can use to email or mail to Akelius Canada Ltd. along with instructions on how to calculate the rent reduction. Use this letter to notify Akelius Canada Ltd. you will be exercising your legal right to reduce the rent as ordered in order TSL-84316.

REASON FOR INCLUDING LETTER WITH YOUR JUNE 1, 2023 RENT PAYMENT

The following law was passed by Premier Doug Ford and the Ontario Conservatives on July 21, 2020, called Bill 184, Protecting Tenants and Strengthening Community Housing Act, 2020.

SECTION

(24) The Act is amended by adding the following section:

Rent increase deemed not void

135.1 (1) An increase in rent that would otherwise be void under subsection 116 (4) is deemed not to be void if the tenant has paid the increased rent in respect of each rental period for at least 12 consecutive months.

Non-application

(2) Subsection (1) does not apply with respect to an increase in rent if the tenant has, within one year after the date the increase was first charged, made an application in which the validity of the rent increase is in issue.

THE BOTTOM LINE – Akelius Canada Ltd. and many other landlords are avoiding reducing the rent of tenants involved with these expired AGIs hoping their tenants have lost the paperwork or have forgotten about these past AGIs, which are now expiring.

EXAMPLE: Many AGIs for balcony repairs and new window installations years ago ordered the tenants to pay increases of 6-9% are starting to expire. The tenants at 111 Lawton Blvd. received a 6.65% increase for balcony restorations. If you keep paying the rent issued on future N1 notices by Akelius Canada Ltd. and they have not included the reductions for twelve months you lose the right to claim the above guideline rent reduction.
